Fatal accident in Wisconsin involving farm tractor

Owning the family farm these days is not as “rural” as it was in the past. The days of riding the tractor across the farm without coming into contact with other vehicles are over. Sometimes, it becomes necessary for farmers to drive their equipment, such as tractors, on the main roads. This may cause a certain amount of annoyance for many Wisconsin motorists, and occasionally, it can cause a fatal accident.

A 74-year-old man was driving on Highway 10 recently. He was in the outside lane on a farm tractor, hauling a gravity box. A passenger car was heading in the same direction when it slammed into the back of the tractor. Both the driver of the car and the farm tractor were taken to the hospital with unspecified injuries.

The condition of the car driver is not yet known, but the tractor driver was not as lucky. He succumbed to the injuries he suffered in the crash despite the efforts of medical personnel to save his life. The Wisconsin State Patrol and Wood County deputies are investigating the accident. There is no word yet as to what charges, if any, may be filed against the driver of the car that rear-ended the tractor.

The family of the deceased farmer retains the right to file a wrongful death claim against the driver in connection with this fatal accident, even if criminal charges are not filed. However, if a conviction is charged and ultimately secured, proof of that conviction may be offered as evidence of negligence in a related civil proceeding. Once negligence is established, the civil court will consider the family’s request for monetary relief.
